General Terms and Conditions

Offers   
All information is non-binding with regard to the price, quantity and period of
delivery. Order confirmations are not normally issued.
Prices   
The prices are those which have validiy on the date of shipping.
Minimum order value   
50.00 EUR within Germany, export 3,000.00 EUR.
Shipping costs   
No shipping costs are payable within Germany as from a minimum order value of 100.00 EUR. A freight costs lump sum is payble for order values of less than 100,00 EUR. Export deliveries are made ex works.
Terms of payment   
Should nothing to the contrary be agreed to, invoices are always payable within a period of 7 days from the date of the invoice subject to a prompt payment discount of  3% or within a period of 30 days net, irrespective of receipt of the merchandise. Special agreements are only valid if they are confirmed in writing.
Shipping/Periods of delivery   
Periods of delivery are only binding if they have been confirmed in writing. Situations which are outside our control, e.g. an act of god, strikes, etc. which impair the completion of the order, entitle us to exceed periods of delivery or rescind the contract. A claim for compensation cannot be derived from this.
Reservation of title   
All merchandise remains the property of the company until such time as the purchase prices including costs and interest have been paid or for as long as we still have claims against the purchaser.
Notification of defects   
Complaints concerning invoices and goods deliveries are to be submitted in writing immediately after receipt of the delivery. Defects which only manifest themselves at a later date, are to be notified by the customer in writing immediately after their detection or the merchandise is otherwise deemed to have been accepted. Complaints concerning the product do not have any effect on the
payment obligation on the part of the customer.
Warranty   
Defects which manifest themselves within a period of 12 months will be repaired by means of them being remedied or by a replacement delivery being made. The manifested defects are to be reported, stating the invoice number, the date of delivery and the device number. Comair provides an appropriate form for the processing. The warranty does not cover damages for which the purchaser is responsible, e.g. damages resulting from wear, moisture, excessive heating of the room, intensive radiation with sun or artificial lighting, other temperature or atmospheric influences or an incorrect use.
Returns   
Before returning items, the customer is to request an authentication number which is to be stated when returning the item and in all subsequent inquiries. Comair is unable to accept and process unannounced returns without authentication. Returns are to be made within a period of 7 days in an unused and perfect condition and in the original pakaging together with all instructions and accessories and a copy of the invoice. The returning of large parcels (furniture, etc.) is be subject to a processing fee of 10% of the value of the item. Special orders cannot be returned. A full reimbursement for goods which are damaged as a result of the use substandard packaging when returning them is not possible. Shipping costs incurred for the returning of the goods are to be borne by the customer.
Miscellaneous   
Collateral agreements which deviate from these general terms and conditions are only valid if they have been confirmed in writing.We wish to point out that we store and process customer data which we obtain in the scope of the customary business transactions in the meaning of the German Data Protection Act. German law has validity for all agreements. The place of performance and the legal venue is Viersen, Germany.
